multiple accounts for same email could cause account duping, it's much easier to make alt accounts (which are already against the rules unless you get approval from chess.com staff)
Sign up for an alternative email somewhere. There are many options.
As mentioned, it is *not* illegal to have a second account. A single alternative account is allowed for each user, but *only* with permission of chess.com staff. The alternative account request form is on this page: https://support.chess.com/article/596-can-i-have-multiple-accounts
(it's not difficult to get this done, and they will allow it so long as you give a reason and agree to abide by some strict rules -- see that link for more detail)
HOWEVER, this is not an alternative account if it is truly for your brother and not you. Just obtain a yahoo or gmail or whatever email account, and apply per the usual way. This is not terribly difficult: ask an adult family member for help if you need it.
