Chess.com acts on the evidence they have, not on the evidence you see. They have no obligation to share that evidence with you, and the cheating was not necessarily in the OTB game against Carlsen, but Carlsen's actions there may have prompted them to review their evidence and/or run different sorts of reports against the games they do have and that has moved their level of confidence from what it was before (which may have been anything from "not cheating" to "probably cheating but not quite certain enough to him (yet)") to "beyond reasonable doubt cheating".
And for all your accusations of Chess.com's heavy handedness, the reality is that they're super cautious and they haven't yet banned anyone for insulting them - in their own forums, mind you - or accusing them of greediness. Sometimes accounts making those of insults do get banned, but for actual violations of the Terms of Service rather than what they've said about Chess.com - although of course insulting the people who own the site does tend to attract their attention to review said account more closely. Which is exactly the same thing as Carlsen's action prompting them to have a closer look.
I've been looking into these cheating accusations currently levied against Hans Neimann. I have no opinion on guilt or innocence because only Hans truly knows at this point so this is not a defense nor attempt to clear his name, I acknowledge there are some points to the accusations. My issue is chess.com's usual overzealous attitude when their mouthpiece Hikaru makes his usual cheating accusations toward anyone. For those of you who don't know, Hikaru has a history of making false accusations of cheating including getting a teacher temporarily banned on his word alone (it was reversed once they investigated which proves my point of FALSE accusations). Hikaru has never met an accusation he didn't like and is a regular whiner when someone shows a hint of brilliancy against him. Top this with the fact that chess.com has a financial stake in Magnus' brand, the other party hinting at cheating accusations (he at least had the decency to NOT make a knee jerk accusation that's unprovable). This sets the stage for chess.com to currently suspend Han's account over OTB accusations. I understand he was previously banned for cheating, that's not important here for a simple reason: Chess.com chose at the time to reinstate his account and move forward. The reason for them suspending currently has nothing to do with any activity on the website and everything to do with optics and the aforementioned financial relationships. That is the reason I find it shameful to lash out at Hans before the facts are known. If it turns out to be accurate, which there has been zero evidence to date to verify, I would support a lifetime ban from all chess forums on or off the board as it would be the most egregious cheating scandal in chess history. It's the punishment before investigation followed by putting the onus on Hans to prove a negative (which is impossible). Chess.com works the opposite of the justice system and requires people to prove innocence to allegations, which is impossible and convenient for the site to justify their actions. I believe their preemptive punishment without due cause, without accusation on site, and preemptive to any conclusive investigation is directly fueled by financial incentives, particularly with the Magnus brand. This profit first mentality is just one of the reasons I rarely play on this forum and use it more for social interaction with friends who aren't on my main sites. I know this may cause them to retaliate against me but I don't care. Even if it comes out that Hans did cheat it would not justify their actions due to them acting before the facts become known. If this has been levied against Magnus himself they would have defended him and refused to react (once again due to them being financially tied to the Magnus brand). This is an issue as the focus should be chess first, but that will never be the case with chess.com as money directly drives their decisions. If I get closed suddenly it was nice playing with you guys.
