Is the A.I cheating?

A.I. opponents don't cheat ever. They do what they are told and have permission to use an engine to various degrees on chess.com.

If the computer just has a king it's up to you to ensure you checkmate as soon as possible and avoid stalemate. The best way to do this is look for at least one move your opponent can make after your move (tedious, but worth half a point)
I have this same frustration. Although by the strict rules the AI is not cheating theoretically. The AI is essentially being a sore loser. Yes it's a computer algorithm, but a human programmed it. I find the incessant 3 fold repetition which forces a game draw to be obnoxious as well. It comes down to poor programming.
